By utilizing the OPL-AI platform, the **License Holder User agrees to act as the primary Data Controller for all application-generated data** and accepts the terms outlined in this Policy.

2. Data Controller and Status Distinction (Platform Provider)

OPL-AI Software operates with a dual status based on the type of data:
a) **Data Controller:** Only for platform membership and security data.
b) **Data Processor/Platform Provider:** For all data collected via OPL-AI Desktop and Mobile Applications, acting strictly as a technical storage and reporting service for the **License Holder User**.

3. Personal Data Collected and Roles in Collection

We collect and process data strictly to provide the technical service. The roles are defined as follows:

  • Data Under OPL-AI Software Control (Data Controller):
    • First and Last Name, Email, Phone: For account management.
    • Encrypted Password Hash: For secure access.
    • IP Address: For platform security and legal compliance.
  • Application Data (Controlled by License Holder User/Data Processor Status): Data collected by the License Holder User from their Sub-Users via OPL-AI applications. This includes:
    • Active Process Names and Titles, Start/End Time, Total Duration.
    • Location (Lokasyon) Information (User-selected, not GPS), Project/Company/License Key.
    • **Mapping Module:** Active GPS Location (Latitude/Longitude) and Plate Number (if configured by the User).
    **Note:** All legal responsibility for the collection, disclosure, and processing of this Application Data lies **exclusively with the License Holder User.**

4. Purposes and Legal Bases for Processing Personal Data

Data is processed based on the necessity for contract performance (Membership Agreement) and the legitimate interests of OPL-AI Software (platform security).

  • Platform Service Provision and Contract Fulfillment: Creating accounts, linking license keys, and technically enabling the viewing/analysis of application data for the License Holder User.
  • Platform Improvement and Security: Analyzing website usage patterns (not application data) to enhance service quality, maintain system stability, and comply with security obligations.
  • AI-Based Data Interpretation: Technical interpretation of the License Holder User's raw data using AI models to generate reports **on behalf of the User.** This does not involve automated decision-making by OPL-AI Software.
  • Legal Compliance: Fulfilling obligations mandated by Turkish law and responding to valid requests from judicial/administrative authorities.

5. Transfer and Non-Sharing of Personal Data

We **strictly do not share** the application usage data (Process, Duration, Location) with any external third parties. This data is segregated and only accessible by the associated License Holder User. Only membership and security data (IP, Name, Email) may be shared with competent authorities as required by law.

6. Retention Period for Personal Data

  • Application usage data (Process, Duration, Location) is stored for a maximum of **seven (7) days** and is then automatically and permanently deleted from our system.
  • Upon request by the License Holder User, application data will be deleted within **three (3) business days** (in accordance with legal storage requirements).
  • Membership registration and security data is stored for the duration of the membership and subsequently for the statutory retention periods.

7. Data Security Measures (Platform Responsibility)

We implement robust technical and administrative measures to secure the platform and the data stored by us:

  • Secure Databases and Encrypted Password Hashes: Data is stored in secure, access-controlled databases.
  • SSL (Secure Socket Layer) Encryption: All data communication between the user's browser/applications and the platform is protected via SSL/TLS.

Veri sahipleri KVKK ve GDPR uyarınca haklara sahiptir. Bu haklar öncelikle OPL-AI Software'in veri sorumlusu olduğu **Üyelik Verileri** ile ilgilidir. **Uygulama Verileri** için bu haklar **Lisans Sahibi Kullanıcıya** karşı kullanılmalıdır.
